Women make up more than half of the population in Canada, but when it comes to healthcare, they often face disproportionate challenges and struggle to receive the care they deserve. At Hammerco Lawyers, we are here to address those challenges head-on. Our Medical Negligence practice group, led by partners Dale McGregor and Alexia Majidi, is committed to standing up for women who have been harmed by medical professionals’ negligence.

Despite advances in medicine, the statistics paint a stark picture of the state of women’s health in Canada and beyond. From VGH UBC Hospital Foundation, “Women distinctly and continually face inequity when it comes to their health. Women’s health is understudied and underfunded and is having a real-world impact: 75 percent of adverse drug effects occur in women. 70 percent of patients with “medically unexplained symptoms” are women. And women are more likely to be dismissed when entering into emergency departments.

“Today in Canada, women are more often misdiagnosed, misunderstood, and misrepresented than their male counterparts.” 

These numbers aren’t just statistics—they represent real women with real health issues being overlooked or dismissed. For example, childbirth complications are often not taken seriously until it is unfortunately too late, and gynecological issues can go undiagnosed for years despite voiced concerns by patients.

Women’s health is grossly understudied and underfunded, and this lack of focus has a devastating real-world impact. But at Hammerco, we believe that every woman deserves to have her voice heard, her pain recognized, and her health prioritized. We are dedicated to ensuring women receive the care and attention they deserve—and when that care falls short, we are here to fight for justice.

Among our current cases, we represent more than a dozen individual victims of the “fake nurse” at BC Women’s Hospital in Vancouver. Additionally, we represent women who have been severely injured as a result of medical negligence, including:

  • Incidents of negligence during delivery causing injuries to the mother and, in some cases, injury to the newborn (birth trauma).
  • Lack of follow-up by doctors resulting in missed or delayed cancer diagnosis.
  • Surgical errors causing injury during routine surgeries such as hysterectomy or oophorectomy (removal of one or more ovaries).
  • Failure to provide timely treatment to patients.
  • Lack of informed consent—failing to disclose all risks and benefits of a certain course of action or failure to provide alternative measures.
