Case Updates
The parties attended the settlement approval hearing before Justice Francis on October 11, 2024. At the hearing, Justice Francis approved the settlement, in addition to the payment of legal fees, disbursements and the honorarium. On July 1, 2025, Justice Francis was elevated to the BC Court of Appeal.
The parties are in the process of scheduling an appearance before a Justice of the BC Supreme Court to report to the Court on the outcome of the administration of the Distribution Protocol, pursuant to s10.1(e) of the Class Action Settlement Agreement. This website will be updated once a date has been provided by the Court.

Background
On July 5, 2019, Hammerco Lawyers filed a proposed class action against WestJet alleging WestJet improperly charged and collected a fee for its passenger’s first piece of checked baggage.
Against the defendants, the class action is seeking to recover the fees collected by WestJet for the first-checked baggage during the class period. The class action also seeks punitive damages from WestJet for their conduct.
