Hammerco Lawyers’ Managing Partner Morgyn Chandler and Associate Zoë Marler successfully secured an award of over 1 million dollars in compensation for their client, who sustained severe physical injuries in a motor vehicle accident in 2016.
The Plaintiff was involved in a rear-end collision in November 2016. As a result of the accident, she sustained a disc injury in her spinal cord, which required surgery and was likely to require further surgery in the future. As a result of her injuries, she was unable to continue working, and her ability to enjoy a full and active life was greatly impacted.
The Defendants attempted to argue that she left the workforce for reasons unrelated to the accident and that she chose not to return due to various factors in her life, including a disinclination to work and an ongoing and challenging family law litigation matter. Morgyn and Zoë successfully argued that the defendant’s arguments should be rejected outright. Not only was their position not grounded in the evidence, but it was based on outdated notions of the reasons women may stay at home and care for their children.
The Honourable Madam Justice Sharma found that the Defendants position was flawed. She found that the plaintiff has a solid history and strong attachment to the workforce and awarded $125,000 for past loss of earning capacity and $475,000 for future loss of earning capacity.
Madam Justice Sharma found the plaintiff to be a “candid and forthright witness” and concluded that the injuries she suffered had a “drastically negative impact on her life.”

The judgment included compensation for pain and suffering, loss of past income-earning capacity, loss of future income-earning capacity, cost of future care, and special damages (out-of-pocket expenses).
