Hammerco Managing Partner Morgyn Chandler and Associate Hailey Reid have secured a judgment in the BC Supreme Court for a client who was sexually assaulted by a lawyer whom she had consulted.

The defendant, Marc Scheirer, was convicted of the offence in criminal court and later disbarred by the Law Society of British Columbia. Our client, K.H.C, then brought a civil claim for damages related to the assault.

Justice E. McDonald found that Scheirer’s conduct was “highly reprehensible” and awarded $270,000 in damages, including $50,000 in punitive damages. Punitive damages are meant to punish, denounce, and deter.

This decision reaffirms that those who abuse positions of trust can be held accountable through the civil courts. Additional information can be found at the Times Colonist and CTV News
