Uber
Hammerco, together with Duboff Edwards Schachter, is pursuing a class action against Uber Technologies Inc., Uber Canada Inc., Uber B.V., Rasier Operations B.V., and Uber Portier B.V. (collectively, “Uber”) on behalf of Alberta drivers and delivery people who use the Uber app to provide rideshare and/or delivery services.
The action claims that Uber’s level of control over drivers and delivery workers effectively makes them employees, and that Uber has wrongly classified them. Because of this alleged misclassification, drivers and delivery workers say they were denied basic protections and benefits under employment standards laws, such as minimum wage, overtime, vacation pay, and holiday pay.
These claims have not yet been proven in court, and the court has not yet decided whether the plaintiff or Uber is right.
Class Membership
On April 25, 2023, the Alberta Court of King’s Bench approved the case to move forward as a class action, allowing it to proceed on behalf of all Alberta drivers and delivery workers who used the Uber app to transport passengers or make deliveries under a service agreement with Uber in Alberta before April 25, 2023.
