SkipTheDishes — Employment Benefits
Hammerco, together with Duboff Edwards Schachter, is advancing a proposed class action on behalf of SkipTheDishes couriers against SkipTheDishes Restaurant Service Inc. The claim says that couriers have been wrongly classified as independent contractors when they are actually employees and should therefore be entitled to employment benefits under provincial laws, such as minimum wage, overtime, vacation pay, and holiday pay.
Before this case can move forward, the Manitoba Court of King’s Bench must first decide whether it can proceed as a class action. If not, couriers would need to bring their claims individually. The certification hearing was held from May 4 to 6, 2026. We are now waiting for the Court’s decision and will post an update on our website when it is available.
Class Membership
The action aims to represent everyone across Canada who signed a “Consultant (Courier) Agreement,” or a similar agreement, with SkipTheDishes Restaurant Services Inc. to provide delivery or courier services.
This includes individuals in Manitoba, Saskatchewan, Alberta, British Columbia, Ontario, Nova Scotia, Newfoundland and Labrador, and Prince Edward Island.
