On March 31, 2026, the parties attended a case planning conference. Justice Jones of the Supreme Court of British Columbia has been assigned as the case management judge of this action.
Background
On June 18, 2025, Hammerco Lawyers initiated an industry class action lawsuit against certain fast-food chain restaurants for failing to clearly disclose delivery and service fees at the outset of the purchasing process. This action alleges that the vendors’ failure to show the all-inclusive price constitutes “drip pricing” and deceptive and/or unconscionable pricing practices in breach of Canada’s Competition Act and various provincial consumer protection laws.
Class Membership Criteria
This proposed class action has been brought on behalf of: all persons who, on or after June 18, 2023, used the delivery services of the Defendants and in Canada to acquire food from any of the Defendants and incurred additional charge(s) including a delivery fee.
