Eco-Diesel
Hammerco, together with Lex Group and Dusevic & Garcha, are advancing class actions against Fiat Chrysler (“FCA”) on behalf of Canadians who own certain Dodge Ram and Jeep Grand Cherokee vehicles equipped with defective exhaust gas recirculation (“EGR”) coolers (see list below).
The claims say that the EGR coolers can crack inside and leak, which can lead to power loss or even engine fires. Although recalls were issued to fix these problems, the actions also claim that the recall repairs don’t fully address the risks.
Before the case can move forward, the courts must approve the actions as class actions, which would allow them to proceed on behalf of the proposed class instead of requiring individual lawsuits. The certification hearing in the BC Action will likely proceed in late 2026.
Proposed Class
The “BC Action” (Andrew Keith Jacquard v FCA Canada Inc. and FCA US LLC, Supreme Court of British Columbia File No. S2010558) seeks to represent all Canadians, excluding residents of Quebec, who own(ed) and/or lease(d) one of the following vehicles:
- 2014-2019 Dodge Ram 1500 containing a 3.0 EcoDiesel engine
- 2014 – 2019 Dodge Ram 1500 Classic containing a 3.0 EcoDiesel engine
- 2014 – 2019 Jeep Grand Cherokee containing a 3.0 EcoDiesel engine
A similar lawsuit was commenced in Quebec on behalf of all Quebec residents (Anis Salhi v, FCA Canada Inc. and FCA US LLC, Superior Court of Quebec (Class Action) File No. 500-06-001105-200) (“Quebec Action”).
