Auto Dealership Industry Class Action
On July 7, 2025, Hammerco Lawyers initiated an industry class action lawsuit against certain B.C.-based auto dealerships for failing to clearly disclose “junk fees” at the outset of the purchasing process for used vehicles. This action alleges that the dealerships’ failure to show the all-inclusive price constitutes “drip pricing” and deceptive and/or unconscionable pricing practices in breach of Canada’s Competition Act, the Motor Dealer Act Regulation, and the Business Practices and Consumer Protection Act.
Class Membership Criteria
This proposed class action has been brought on behalf of: all persons who, on or after July 5, 2023 up to the date of final judgment in this proceeding, purchased or leased a used vehicle from one of the Defendants and paid one or more obligatory fee in addition to the price of the vehicle, including a subclass of individuals that purchased or leased as part of a “consumer transaction” as that term is defined in the British Columbia Business Practices and Consumer Protection Act.
