Am I part of this Class Action?

All individuals residing in Canada (except residents of Alberta, Quebec, Yukon, Nunavut and the Northwest Territories) who had a WestJet Travel Bank credit at any time since October 1, 2009* that was issued in relation to an itinerary that was booked primarily for a personal, family, or household purpose, who paid fees to extend their Travel Bank credit or whose credit expired.

*From September 1, 2010 in PEI, April 1, 2011 in Newfoundland, and February 1, 2010 in Nova Scotia.

Do I need to take any action to be part of this case now?

No action is required at this point. However, please keep all your records including: the cancelled itinerary, the credit(s) issued, correspondence with WestJet customer service or booking agents, proof of fee paid to WestJet to avoid expiration of unused credits, etc.

Can I still commence an individual action

Unless you opt-out within the timeframe ordered by the Court, you will be bound by the judgment from this class action. As such, you may not be able to commence a small claims case on your own. Hammerco Lawyers LLP cannot advise you in an individual action. Please consult your lawyer if you plan to proceed individually.

Will class members be liable for the defendant’s legal fees?

No, class members are not liable for the defendant’s legal fees if this action does not succeed.

When can I hear further information about this class action?

The certification motion hearing for this class action was heard in British Columbia in October 2020. The BC Supreme Court certified this action on December 16, 2020.

We will notify those that have signed up to our Mailing List on the next steps and when they expect an official court-approved notice of certification.

What are we asking for in this class action?

Against the defendants, the class action is seeking to recover compensation from WestJet for all the fees collected by the defendant paid by class members to extend their WestJet Travel Bank credits. The class action also seeks damages equivalent to all WestJet Travel Bank balances that have been seized by WestJet.
